1.- Object and scope of application
The present Particular Conditions of Contract regulate the conditions under which we provide the offered service and the transactions that take place on our website.
From the moment you contract any of the services offered on our website or purchase any of our products, you acquire the status of Client, which implies the express, full, and unconditional acceptance of the conditions governing our relationship.
The present Particular Conditions of Contract are complemented by the provisions in the Legal Notice, General Terms and Conditions of Use, Privacy Policy, and Cookies Policy of Deco&You, accessible through this website.
2.- Applicable rules
Both these conditions and the provision of our services will be governed and interpreted in accordance with Spanish legislation, and more specifically, will be subject to the provisions of Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, to Law 7/1996, of January 15, on the Regulation of Retail Trade, and to Law 34/2002, of July 11, on information society services and electronic commerce.
Our products and services comply with the provisions of Spanish legislation; therefore, if your residence is located outside Spanish territory, you may be subject to the mandatory provisions of the legislation of your country of habitual residence. In that case, it will be your responsibility to verify, prior to contracting our services or purchasing our items, your applicable legislation, exempting Deco&You from any liability in this regard.
3.- Commercial conditions and product description
The information we provide about commercial conditions through the website is presumed to be accurate and current as long as it is published on the website. However, exceptionally, there may be some typographical or similar error beyond our control. If the error was decisive at the time of purchasing the product, you may rescind the purchase operation at no cost.
The contents, descriptions, and services offered on the website are provided in Spanish; however, since Deco&You makes every effort to ensure the general understanding of them by its users, it offers a courtesy translation in other languages. These translations do not have official status, so Deco&You cannot guarantee their accuracy and will not assume any responsibility for errors that may arise from interpretative errors caused by the translation, all of which is without prejudice to the possibility of offering you an official and comprehensive translation of our contents in the future.
Deco&You may modify the existing commercial offers on the website at any time, both regarding products and prices, promotions, and commercial conditions.
The offered products, their characteristics, and prices will be those detailed on the screen as applicable. The offered prices will include VAT, which will be specified during the purchase process. Regarding shipping costs, the provisions in the Shipping Costs section will apply.
From Deco&You, we try to offer images as close to reality as possible; however, we cannot guarantee total accuracy between the supplied product and its graphic representation in the images included on the website, especially regarding color tone or in the case of a manufacturer's range renewal, with the external appearance of the product or its presentation. We also highlight that the supplied products may suffer color variations between different dye baths, especially coinciding with different production batches of the product.
Consequently, Deco&You will not assume any responsibility for the difference between the supplied items and their graphic representation in the images included on the website.
Types of products that can be purchased through the platform
The products we offer on the platform are divided into two categories:
Standard or retail product: This category of product may be available in stock or by order. Those products that are not in stock at the time of purchase may be ordered through the platform and will be manufactured to order.
It is important that you know that when you purchase standard or retail products out of stock and have placed an order for their manufacture, you acknowledge and assume that during the manufacturing and delivery period of these types of products you will not be able to exercise your right of withdrawal, nor after their delivery.
Custom products: This category of products is manufactured according to the customer's specifications or personalized (for example, custom fabrics, wallapaper, murals, etc).
The items can be purchased individually or in bulk, and this will depend on the characteristics of the item purchased. In cases where items are purchased in bulk, the product condition will be held by the complete lot.
Product samples
Deco&You offers the possibility to purchase samples of certain products to know precisely the details of the product intended for purchase. The products that allow the possibility of acquiring samples are: wallpaper and fabrics (different from cushion covers, bedding, and finished textile products, lighting, etc).
The cost of the samples will be as indicated on the screen in each case. If after purchasing the samples you decide to acquire the product, the price of the samples will be deducted from the final price.
The samples of the products are indicative as the color of the product may vary from the color of the supplied samples, taking into account the possibility of changes in the production lot. In this regard, Deco&You will not be responsible for any color variations that may exist between the samples and the supplied products.
4.- Purchase process through the website
The procedures for acquiring products through the website are those established in these Particular Conditions of Contracting, and where applicable, those indicated on the portal during navigation.
To place an order for the products offered through the website, you must register as a User, following the instructions that appear on the screen or have prior access credentials. We provide you with two ways to register: Registration as an Individual and registration as a Professional.
To be registered as a Professional, Deco&You will require you to prove your status as professionals related to the decoration or interior design sector prior to your registration.
The information provided during the registration process must be accurate, truthful, and up-to-date. You as a Customer will be solely responsible for the consequences arising from providing inaccurate, untruthful, and outdated information. Likewise, you will be solely responsible for any direct or indirect damage or harm that may be caused to Deco&You as the responsible party for this website or to third parties, if you fill out the data forms with false information or that of third parties causing deception, damage, or harm. If Deco&You verifies or has sufficient indications that the information provided does not meet the established requirements, it may, at any time, cancel your account.
Once the registration process on the website is completed, you must follow the instructions that appear on the electronic form that Deco&You provides to process the order. This form will be sent to Deco&You to formalize the purchase.
Within a maximum period of 24 hours from the purchase, you will receive an email at the account provided for this purpose, confirming the purchase made and the details of the order. If you notice any errors in the confirmation data or disagree with them, you must contact Deco&You requesting the correction of the data or the cancellation of the order.
The purchase confirmation and order details do not constitute an invoice; in any case, the invoice will be sent to you at the time of delivery of the merchandise or will be available in your customer account.
Since Deco&You cannot guarantee at all times the availability of the requested products, orders will be processed in strict order of request.
5.- Payment for the product
The payment for the products purchased through the website will be made through the following payment methods at the time of purchase:
• Payment by bank card
• Payment by Paypal
• Bank transfer
To make the payment through each of the above payment methods, you must follow the instructions that appear on the screen and pay the purchase amount.
We guarantee that each of the transactions made at Deco&You is 100% secure. All operations involving the transmission of personal or banking data are carried out using a secure environment. Deco&You uses a server based on standard SSL (Secure Socket Layer) security technology. All information you transmit to us is encrypted as it travels through the network. Furthermore, the data about your credit card is not stored in any database but goes directly to the POS (Point of Sale) of the Bank.
Additionally, we inform you that in an effort to provide greater security to credit card holders, we have incorporated into our payment gateway the secure payment system called CES (Secure Electronic Commerce). In this way, if you are the holder of a "secured" card, you will always be able to make payments with VISA or MASTERCARD in our store.
If your card is not attached to this payment system, Deco&You will only accept payment by VISA or MASTERCARD credit card from customers with proven seniority and reliability.
In both cases, when paying with a VISA or MASTERCARD card, the following information will always be requested: the card number, the expiration date, and a Validation Code that matches the last 3 digits of the number printed in italics on the back of your VISA or MASTERCARD card, thus providing more guarantees regarding the security of the transaction.
Important: Credit card fraud is a crime, and Deco&You will take legal action against anyone who makes a fraudulent transaction in our online store.
6.- Shipping costs
The prices of the products offered on the website do not include shipping costs. These costs will vary depending on your place of residence and any offers and promotions that may exist at any given time. In any case, the costs displayed on the screen during the purchase process will apply.
Shipments made to the Canary Islands, Ceuta, and Melilla or regions not belonging to the European Customs Union will require the recipient of the goods to pay the import duties upon arrival.
All orders allow for partial deliveries and invoicing. Subsequent shipments made to fulfill the same order may incur shipping costs; in any case, the information will appear on the purchase screen. Deco&You will offer you the option to choose between waiting for the entire order to be complete or the possibility of receiving partial deliveries.
7.- Delivery times
The maximum expected delivery time for standard or retail products will be 15 business days, as long as we have stock. If the purchased product is not in stock or is a custom product, the delivery times will be conditioned by the manufacturing times. Products whose deliveries require different times will reflect this particularity in their description.
If the chosen product is not available, due to being out of stock or a custom product, Deco&You will contact you and, if possible, will indicate an estimated delivery date.
If it is not possible to deliver the purchased product, Deco&You will offer you the option to cancel the purchase or acquire a product with similar characteristics.
As a Customer, you must provide the shipping address to Deco&You. The shipment will be made through a courier service. If at the time of delivery you detect any discrepancy with the delivered product, you must indicate it in writing on the delivery note and contact Deco&You immediately at the address info@decoandyou.com.
Deco&You will not be responsible for errors made when providing the shipping address or for the absence of the recipient at the specified address.

9.- Intellectual Property
The intellectual property rights of the products offered through the website belong to Deco&You or third parties. As a Customer, you will not acquire any rights over these rights, and reproduction, transformation, public communication, and/or dissemination of the products supplied through the website is prohibited.
Any infringement of intellectual and industrial property rights, unless you have the express and unequivocal consent of its legitimate owner, may be reported and pursued legally.
10.- Assignment of the contract
As a Customer, you may not assign your contractual position and the rights and obligations arising from the acquisition of products through the website to third parties without the express consent of Deco&You.
Deco&You may assign its legal position in this contract to another company that can market the product offered through the website, notifying you in advance.
11.- Resolution
The following will be causes for resolution of the contract, in addition to those legally provided:
• Mutual agreement of the parties.
• Extinction of the legal personality and/or death of one of the parties or judicial declaration of bankruptcy of either party.
• Failure to pay the agreed price, including taxes, or shipping or return costs.
• Non-compliance by the Customer with these Particular Conditions of Contracting or those provided in the Legal Notice, Terms of Use, Privacy Policy.
12.- Communications and notifications
All notifications that Deco&You must make will be directed to the email address you provided when filling out the purchase form, and alternatively to the address provided.
All communications or notifications you send to Deco&You can be sent to the following email addresses: reclamaciones@decoandyou.com for communications related to returns and claims for defective products; privacidad@decoandyou.com for communications related to your privacy; and info@decoandyou.com for communications not related to the above.
13.- Integrity of the contract
If any of these clauses are declared total or partially null or ineffective, such nullity or ineffectiveness will only affect that provision or the part of it that is null or ineffective, with the present contracting conditions remaining in all other respects, considering such provision, or the part of it that is affected, as not made.
The present contracting conditions, as well as prices, items, and offers may be modified at any time and without prior notice by Deco&You. The referred modifications will be published on the website for your knowledge, coming into effect from the moment of their publication. The modifications made will not have retroactive effects on those acquisitions that were carried out prior to the publication of such modification.
14.- Applicable legislation and jurisdiction
This contract is subject to Spanish legislation.
In case of any controversy regarding the interpretation or application of these contracting conditions, it will be submitted to the Courts and Tribunals established by the applicable legislation. In the case of final consumers, the place of fulfillment of the obligation or the domicile of the purchasing party will be taken into account. If you have your domicile outside of Spain or have the status of a professional, the controversy will be resolved, expressly waiving any other jurisdiction that may apply, to the Courts and Tribunals of the city of Valencia (Spain).
